Terms of use

Version of — effective from .

This English version is provided for convenience; the French version prevails.

1. Who we are and what these terms cover

The Offload app (the ‘App’) is published by Jean-David Viala, individual (registration in progress), contact details provided to the host (French law no. 2004-575 of 21 June 2004, article 1-1 II) (the ‘Publisher’, ‘we’). Full details are in the Legal Notice.

These Terms of Use (the ‘Terms’) govern your use of the App. You accept them by creating an account.

How we process your personal data is described in the Privacy Policy, which forms part of these Terms.

2. Eligibility: 18 and over

The App is for people aged 18 or over with legal capacity to contract. By creating an account you confirm that you meet this condition.

Why: the App’s assistant relies on the Google Gemini API, whose terms require users to be at least 18 and prohibit services directed at minors.

Children do not have accounts. You may mention children in your household (first name, optionally surname and date of birth) under your responsibility as parent or legal guardian, entering only what is necessary.

3. The service

Offload helps a household organise daily life: tasks, appointments, lists, useful contacts, reminders, widgets, and an assistant that understands what you type, dictate or photograph and suggests actions.

Works without AI: tasks, calendar, lists, reminders and simple commands. The AI assistant’s features are only active after your explicit consent, which you can withdraw at any time (Settings › Assistant).

We keep improving the App, including through automatically installed updates. We may add, change or remove features.

4. Your account

  • You create an account with an email address and password, or through Apple or Google. You provide accurate information and keep your credentials confidential.
  • You are responsible for what is done from your account. Tell us promptly about any unauthorised use: support@theoffloadapp.com.
  • An account is personal: one person, one account.

5. Shared households

  • A household (‘space’) is created by a member, who approves every request to join. Members of a household can see and edit its shared content (tasks, lists, appointments, contacts, people, household profile, assistant memory). Your free-form conversations with the assistant stay private.
  • Only invite people with whom you are happy to share this content. Only enter information about another adult (for example your partner’s medical appointment) if you are entitled to do so.
  • If you leave a household or delete your account while other members remain, the shared content you created stays with the household (see the Privacy Policy).
  • A household’s automatic briefs and suggestions only work once every member with an account has accepted the AI assistant.

6. The AI assistant: what it is and isn’t

  • You are using an artificial intelligence system. Its replies are generated automatically and may be inaccurate, incomplete or unsuitable. Review any suggestion (date, time, person, recipient) before confirming it; the assistant suggests, you decide.
  • No medical advice. Offload is not a medical device and provides no medical advice, diagnosis or treatment, nor legal, financial or psychological advice. Reminders about appointments, prescriptions or treatments are organisational aids: they do not replace a health professional’s advice or your own care. The Gemini API terms also prohibit using it to provide medical advice.
  • Emergencies: call 112, 999 (UK), 911 (US/Canada), 000 (Australia) or your local emergency number. Never use Offload for an urgent situation.
  • A reminder may fail to fire (notifications off, phone off, network or provider outage). Do not rely on Offload alone for a critical deadline (taking medication, a legal deadline).
  • The assistant can draft a message (text, email): it opens in your phone’s Messages or Mail app and is only sent by you. You are its author and are responsible for it.
  • AI use is capped per person per day to keep the service available to everyone.

7. Your content

  • You own what you enter (text, photos, lists…). You grant us, only for as long as necessary, a non-exclusive, royalty-free right to host, copy, process (including through our processors, and the AI if you have accepted it) and display it to your household members, solely to provide the service to you.
  • You confirm you have the right to enter this content and that it is lawful.
  • In particular, the following are prohibited: unlawful content (hateful, violent, child sexual abuse material, infringing, defamatory…); harassing a member; impersonation; any attempt to access another household’s data, bypass limits or protections, scrape data in bulk, or reverse-engineer the App except as permitted by law; using the assistant to generate content prohibited by Google’s usage rules.

8. Purchases

No purchases are offered in the App today. If a subscription is offered, this section will be completed (price, renewal, cancellation, refunds, right of withdrawal) and you’ll be told before you’re charged anything.

9. Reporting illegal content (EU Digital Services Act)

Offload hosts content provided by its users, visible only to members of their household.

  • Single point of contact (authorities and users): contact@theoffloadapp.com, in French or English.
  • Notice: any user or person can report content they consider illegal, stating: the reason, the exact location of the content (household, item), their name and email address (except for certain child sexual abuse content), and a statement of good faith. We acknowledge receipt, handle the notice diligently and objectively, and tell its author our decision.
  • If we remove content or restrict an account, we tell the person concerned, with reasons and means of redress (complaint to us, then the courts).

10. Availability and liability

  • We do our best to keep the App running, without guaranteeing continuous availability. Interruptions may occur (maintenance, outage at a provider: hosting, AI, Apple or Expo notifications).
  • We are not responsible for: decisions you make based on the assistant’s suggestions; a missed reminder caused by your settings, device or network; content entered by your household members; third-party services you open from the App (maps, messaging apps, booking sites…).
  • Nothing in these Terms limits our liability for gross negligence or wilful misconduct, personal injury, or the statutory rights you have as a consumer (including legal conformity guarantees for digital content and services).
  • Export your data regularly if it matters to you (Settings › Data & privacy › Export).

11. Suspension and termination

  • You can delete your account at any time in Settings › Data & privacy › Delete my account.
  • We may suspend or delete an account for a serious breach of these Terms (illegal content, security attack, abusive use), after a warning unless urgent or legally required, stating our reasons.
  • If we shut down the service, we will give you reasonable notice in advance so you can export your data.

12. Intellectual property

The App, its name, design and code belong to the Publisher. We grant you a personal, non-exclusive, non-transferable right to use the App for your private needs, in line with these Terms and the App Store terms.

13. Changes to the Terms

We may change these Terms. We will tell you in the App about any significant change before it takes effect, giving reasonable notice. If you do not accept the new version, you can delete your account.

14. Governing law, complaints and mediation

  • These Terms are governed by French law. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country.
  • Complaints: support@theoffloadapp.com. We usually reply within two working days.
  • Consumer mediation. A consumer mediator will be appointed before any sale; their details will appear here.
  • Failing an amicable solution, disputes may be brought before the courts with jurisdiction under ordinary rules.
